Privacy Notice

At Move Beautiful Limited (we, us, our) we care about our subscribers, our website users and business contacts (you, your) as well as the protection of your personal data. To ensure that we provide the best possible information, we are providing this notice to let you know how we collect and use your personal data, and your rights in connection with it.

Move Beautiful Limited is the data controller of any information that we collect about you, and is registered with the Information Commissioner’s Office under registration number A8750158. If you have any questions regarding how we use your data then you can always contact us using the contact information provided at the end of this notice.

When does this Notice apply?

This Notice applies when you use our website, contact us via our website or through other means, when you request or obtain our services, or when you subscribe to receive newsletters, updates, surveys, promotions and other direct marketing messages, including when we create distribution lists, issue marketing communications and process responses to those communications.

This Notice also applies to service providers, suppliers, business partners, affiliates, advisors and other third parties (along with their respective officers, agents and employees) when interacting with us in relation to our activities, service offering or related business opportunities.

How do we collect personal data?

To ensure that we operate our business to the best of its abilities and to provide the best possible subscriber experience, we have to process certain types of personal data. The majority of the information that we collect will be provided by you directly. However, there may be circumstances where we collect information about you from other sources, including third parties and publicly available sources (such as social media profiles).

What types of personal data do we use?

We process the following categories of personal data:

  • your name;
  • your address;
  • your contact details (including your telephone number, address and email address);
  • your gender;
  • your contact history with us;
  • details of services you have requested from us or that we provide to you, and any information relating to those services including any reviews, testimonials or feedback that you provide;
  • when you become a subscriber, your financial institution and associated account information;
  • footage that you submit to us in connection with the services that we provide to you, including imagery of you and the contents of any accompanying audio;
  • where you act on behalf of a service provider, supplier, business partner, affiliate, advisor or other third party, your employer, role and employment location;
  • your communication and marketing preferences;
  • your feedback and survey responses;
  • your IP address and location; and
  • your on-line browsing activities on our website.

In addition, we may process special category data relating to subscribers to the extent that such data is included within footage or other imagery that you provide to us in order to receive our services. This includes information revealing your racial or ethnic origin, religious or philosophical beliefs, sexual orientation or data concerning your health.

While we believe in the power of running and exercise for all, we do not provide our services to children or legal minors, and so do not intentionally process data relating to such persons.

Why do we use your personal data?

We process different categories of personal data for different purposes. Generally, we will use your information to:

  • process and respond to service related enquiries;
  • enter into and manage our relationship with you;
  • provide subscriber service and support;
  • issue marketing communications in relation to our business and our services;
  • issue and process responses to surveys; and
  • manage and make improvements to our business and website.

If circumstances change and we think that we may need use your data for another purpose, then we will update this notice to let you know about this beforehand.

What is our legal basis for processing your data?

We will typically process your data in order to enable us to enter into a contract with you at your request or, for existing subscribers, to enable the performance of obligations related to our subscription agreement and terms of use. While you are not obliged to provide such information, unfortunately failure to do so may mean that we can’t provide our services to you.

In some circumstances we may process your data based on our legitimate interests in:

  • supplying our services and any related support to our subscribers;
  • improving our existing services and our website;
  • developing new products or services;
  • promoting and advertising our business and services;
  • handling subscriber enquiries and complaints;
  • complying with our legal and regulatory obligations;
  • understanding our subscribers’ preferences; and
  • managing corporate transactions, where we intend to acquire a business or dispose of all or part of our own business.

Whenever we rely on our legitimate interest to use your data, we always consider the impact this might have on you, and will only use our information if we’re satisfied that it won’t unfairly affect your rights.

To the extent that we process special category data, we will only do this where we have your explicit consent prior to collection. In such cases you can always withdraw your consent by contacting us, although that wouldn’t affect the legality of processing already conducted.

Will we share your personal data with others?

In some circumstances, we may need to share your information with others. However, we will only do this with trusted third parties, and where we have the right protections in place. We may share your data with the following recipients:

  • other entities within our group of companies and our corporate affiliates;
  • our trusted partners;
  • payment institutions;
  • service providers that we use as part of our business infrastructure, for example providers of delivery, marketing or IT related services;
  • regulatory authorities, law enforcement agencies and courts, to the extent required;
  • in the event of a sale of our business or part of our business, the purchaser and its professional advisors; and
  • our consultants and professional advisors.

Will we transfer your data overseas?

The information which we collect about you may be transferred and stored outside the European Economic Area. However, we will only do this where the recipient is based in a jurisdiction that has been deemed to provide adequate protection of your data by the European Commission or, alternatively, where we have in place specific contractual protections approved by the European Commission in order to ensure that your data is adequately protected. How do we keep your data secure?

We have implemented appropriate technical and organisational measures to ensure that we are doing everything that we can be in order to protect the security of your data. We regularly review our internal policies, procedures and technical security to ensure that they remain appropriate to the risks of your data being compromised in any way.

Do we conduct automated decision making?

We do not conduct any automated decision making based on the information you provide.

How long will we keep your data?

We only keep your information for as long as necessary to achieve the purposes for which it was initially collected. Generally, information relating to subscribers or other third parties with which we have contractual arrangements in place will be retained for 6 years after the ending of our relationship with them, at which time it will be reviewed and if no longer necessary then it will be permanently deleted.

In some cases we may anonymise data for statistical purposes. Where we do this we ensure that you can no longer be identified by those data, meaning that it no longer constitutes personal data and can be retained for a longer period.

What rights do you have in connection with your personal data?

You have certain rights under data protection law in relation to your data which are listed below, although please note that not all of these apply in all circumstances:

  1. Right of access – subject to certain exceptions, you have the right of access to your personal data that we hold.

  2. Right to rectify your personal information – if you discover that the information we hold about you is inaccurate or incomplete, you have the right to have this information rectified (i.e. corrected).

  3. Right to be forgotten – you may ask us to delete information we hold about you in certain circumstances. This right is not absolute and it may not be possible for us to delete the information we hold about you, for example, if we have an ongoing contractual relationship or are required to retain information to comply with our legal obligations.

  4. Right to restriction of processing – in some cases you may have the right to have the processing of your personal information restricted. For example, where you contest the accuracy of your personal information, its use may be restricted until the accuracy is verified.

  5. Right to object to processing – you may object to the processing of your personal information (including profiling) when it is based upon our legitimate interests. You may also object to the processing of your personal information for the purposes of direct marketing and for the purposes of statistical analysis.

  6. Right to data portability – you have the right to receive, move, copy or transfer your personal information to another controller when we are processing your personal information based on consent or on a contract and the processing is carried out by automated means.

What if we update this Notice?

While we always aim to provide complete and transparent information about how we process your personal data, we reserve the right to update this Notice from time to time in order to accurately reflect changed circumstances or new regulatory requirements. We ask that our subscribers and all other visitors to our website check this Notice for updates periodically, but we will also let you know if there are any material changes.
